Course Description:
Enforcement of the law is a lynchpin to its successful implementation. M.G.L. ch. 21E has provisions that give government prosecutors legal authority to pursue a variety of administrative, civil, and/or criminal actions against violators. This workshop will provide an overview of applicable law, with a particular focus on how the applies to persons involved with 21E contaminated sites.

This two (2) hour training covers the legal framework for enforcement in general, touching on applicability of statutes and regulations to support an enforcement response, discusses the three enforcement forums (administrative, civil, and criminal) within which cases are prosecuted, and explores how government enforcement managers determine the appropriate forum and appropriate enforcement response.
Particular attention is paid to enforcement in the context of M.G.L. ch. 21E and the implementing regulations (MCP).  The training will cover the elements of a 21E high level  enforcement case, likely targets, and traps for the unwary.
