MassDEP has posted the Final GUIDANCE ON IMPLEMENTING ACTIVITY AND USE LIMITATIONS, Policy #WSC 25-300, April 23, 2025, available at: https://www.mass.gov/lists/policies-guidance-technical-support-for-site-cleanup.
Also available is MassDEP’s response to all comments received during the finalization of this document.
An Activity and Use Limitation (AUL) is a legal document that is recorded at the Registry of Deeds (or registered with the Registry Division of Land Court) that notifies current and future property owners, as well as other interested parties, of the presence of residual contamination remaining on the property after assessment and/or cleanup activities are completed. More specifically, the AUL provides information about the activities and uses that are deemed appropriate for the property and the ongoing obligations required to maintain a level of No Significant Risk.
