LSP Board of Registration Announces Regulatory Amendments to 309 CMR— Now in Effect!

On January 30, 2026, the amendments made to 309 CMR 1.00-9.00 were published in the Massachusetts Register.

Amendment Process
The LSP Board began the amendment process in 2024 and issued draft amendments for public comment on May 27, 2025. The LSPA testified at a public hearing on June 16, 2025, and submitted comments on June 26, 2025.

Regulation Amendments
The LSP Board of Registration website includes the following documents: the revised regulations, a redline version of the regulations showing the changes, a background document summarizing the amendments, and a response to comments received. Below is a summary of the key changes:

  • Elimination of Exam Reviews and Challenges section.
  • Reduction in LSP renewal credits from 48 to 36 every three years. This applies to the next group of LSPs renewals by April 30, 2026.
  • Reduction in the number of CE credits needed for a 90-day extension of the deadline to renew a license from 12 or fewer of the required credits to nine or fewer of the required credits.
  • Simplification of CE credit types from Technical, DEP, and Regulatory, to DEP (9 CEs every three years) and non-DEP (27 CEs every three years).
  • Ability to carry over CE credits earned outside a renewal period towards the next renewal period in some situations (see the Background Document Summarizing the Amendments for information on these situations).
  • Updated requirements for online CE courses, including new definitions for “live webinars” and “on-demand”, and what attendees need to do during these programs re polling and assessment of learning questions to obtain credit (this is in line with how the LSPA already conducts programming).
  • New requirements for CE course providers around documentation and audits.
  • The LSP Board now accepts electronic submissions and payments.
