This presentation will facilitate a discussion on environmental response actions at sites that fall into the category of “Adequately Regulated” under the MCP.

Using three to four case studies, the presentation will illustrate how releases of oil and hazardous materials can intersect with other regulatory programs and ultimately qualify for the Adequately Regulated provisions of the MCP. Each example will include a brief overview of the site history, the circumstances under which the release was identified, and how the site came to fall under MCP jurisdiction. The discussion will also highlight the regulatory and technical challenges associated with coordinating response actions across multiple regulatory frameworks, including interactions between MCP requirements and other environmental programs.

For each case study, the presentation will summarize the investigative approach, the roles of different technical disciplines involved in site evaluation and remediation, how regulatory coordination influenced the response strategy, and the overall outcomes, including lessons learned, practical considerations for LSPs and regulators, and key factors that can help practitioners determine when the Adequately Regulated provisions of the MCP may apply.
