MassDEP’s Bureau of Waste Site Cleanup will be holding “Office Hours” on Thursday March 19, 2026, at 9 am with a focus on Active Exposure Pathway Mitigation Measures (AEPMMs).  Assistant Commissioner Millie Garcia-Serrano, John Fitzgerald and Brian Roden will facilitate the discussion.

MassDEP has been working on drafting guidance related to AEPMM Operating Regimens.  An AEPMM Operating Regimen is required under 310 CMR 40.1025(3) and 40.1026(3) for AEPMMs operating under a Permanent Solution, Temporary Solution or Remedy Operation Status.  The operating regimen must be designed to ensure a level of No Significant Risk is maintained for the Receptor(s) of concern under normal operating conditions.  Based on inspections and evaluations of these systems, the Department has determined that steps are needed to better document the efficacy of these systems, comply with MCP performance standards and regulatory requirements, and ensure protection of public health.

To further this effort, MassDEP has decided to host a virtual information gathering session to hear from the public on what elements should be included in the Operating Regimen to ensure a level of No Significant Risk.  The information gathered will be considered in developing the AEPMM Operating Regimen guidance document. 

Questions to consider for the meeting:

1. What specific elements need to be included in the operating regimen submittal?
2. What actions are needed to determine that the AEPMM is continuing to maintain No Significant Risk?
3. What actions are needed to document that specified vacuum levels at SSDS extraction points will equate to a level of No Significant Risk within a building?
4.  What site-specific factors should be considered in determining the frequency of needed on-site inspections?
5. Should periodic indoor air sampling be conducted to document system efficacy and demonstrate a condition of No Significant Risk?
6. How can MassDEP incentivize property owners/system operators to conduct monitoring programs specified in an operating regimen?

The virtual meeting will take place during the scheduled MassDEP BWSC Office Hours on Thursday March 19^th from 9 am to 11 am.
