Lessons Learned From MassDEP Notices of Audit Findings FY2023: Risk Characterization and PFAS

Presentation Description: 
The LSPA February Member meeting will present a summary of the practical takeaways and lessons learned from the Loss Prevention Committee’s review of MassDEP’s Notices of Audit Findings (NOAFs) from FY2023 on the topics of risk characterization, and poly and perfluoroalkyl substances (PFAS).

The presentation will also provide an overview of the FY2023 NOAF reviews conducted by the committee. Ancillary topics related to other NOAF categories that will be covered in brief include the required components of an Activity and Use Limitation, and the availability of certain risk-related MassDEP guidance documents.  The PFAS portion of the presentation, by Dianne Phillips, Esq., Partner, Holland & Knight LLP, will review the growing list of MassDEP audits focused on PFAS which have increased in frequency each year; it will also include a description of several trends which seem to be emerging.

The risk characterization section of the presentation, by Jane Parkin Kullmann, PhD., DABT, Sr. Risk Assessor, WSP USA, will include a review of the NOAFs and the risk-related issues noted therein. Related to these issues, the presentation will also include an overview of the possible approaches for addressing cumulative risk for a site with multiple releases and addressing cumulative risk in the context of partial Permanent Solutions, the applicability of Method 2 risk characterizations, and selecting chemicals of potential concern for indoor air.

20 minutes of Q&A will follow the 70-minute presentation.
