Presentation Description: The LSPA March Member Meeting will provide an overview of MCP requirements and practical considerations for preparing and implementing Notices of Activity and Use Limitations (NAULs).
The presenters, Attorneys Kate Heller and Justin Rheingold of Goulston & Storrs, will discuss several aspects of NAULs, including best practices for drafting, surveying, notifying record interest holders and recording. They will also address common compliance issues related to filing and maintaining NAULs. This presentation will provide value for practitioners independent of the timing of the issuance of MassDEP’s Final AUL Guidance.
This presentation will provide an understanding of when an NAUL might be needed, how to provide appropriate information for whoever is drafting it, and how to work with Responsible Parties to support its appropriate submittal to MassDEP and the Registry. Attendees will be provided with high-level guidance on the fundamentals of NAULs, including considerations for planning and development, fulfilling compliance obligations, and overall implementation and maintenance.
